Terms and Conditions for Driver / Partner
This document is an electronic record under the provisions of the Information Technology Act, 2000, and the applicable rules. If this document is not in a language you understand, you are advised to contact Krikex.com for clarification. By signing up or registering on the Platform and offering to provide one or more of the Services, you acknowledge that you have read and understood these T&Cs and agree to be bound by these T&Cs, without any limitation or qualification. If you do not agree with these T&Cs, please do not sign up or register on the Platform or offer any Services. By clicking the 'I Accept' button on the signup page of the App or on the Website, you confirm your acknowledgment and understanding of this agreement and its exhibits.
This platform is owned and managed by Keshway International LLP, a Limited Liability Partnership (LLP) registered under the Limited Liability Partnership Act, 2008 (LLP Act) in India. The terms "Krikex.com," "we," "us," or "our" refer to Keshway International LLP.
The LLP has developed a technology-driven software called the ‘Krikex.com Driver App,’ which enables drivers registered on the platform to offer transportation services to customers. The LLP provides these services under a Software as a Service (“SaaS”) model, acting solely as a platform to facilitate connections between drivers and customers. This agreement is automatically accepted by the user as soon as the Krikex.com Partner or owner of a vehicle wishes to provide their services as delivery or taxi services and creates their account on the Krikex.com server. Please read all terms and conditions carefully. If you do not agree with any of the terms or conditions, please do not register on Krikex.com.
The Krikex.com mobile app facilitates customers to book a taxi ride or to book food or grocery items available in the area provided by merchants. Any of these services may be stopped or held for a particular time or permanently for any reason, for which Krikex.com or the company does not hold any legal liability.
You can register on Krikex.com as a Krikex.com partner on the server by using the Krikex.com Driver Mobile App. The following details and documents may be required to complete the signup process and to be active in a predefined particular area:

The Krikex.com partner is a self-author for its submission. Krikex.com reserves the right to check and verify the details provided by you. You are responsible for the information provided by you. Any submission made on the Krikex.com platform becomes exclusive content or property of Krikex.com. Krikex.com will not be responsible for any loss or damage caused to the Krikex.com partner due to incorrect or outdated information provided to Krikex.com. Any changes or updates are your responsibility to update on your account through the Mobile App or Customer Care by sending an email to partner@krikex.com.
1. Effective Date and Termination: This Agreement becomes effective from the moment you accept it and will remain in effect until either you or we terminate it.
2. Termination by You: You may terminate this Agreement (a) without cause at any time with seven (7) days' prior written notice to Krikex.com; and (b) immediately by Krikex.com, without notice, if you violate or are alleged to have violated a material provision of this Agreement.
3. Account Deactivation: You agree that we may temporarily deactivate your account without notice to investigate any activity that is deceptive, fraudulent, unsafe, illegal, harmful to our brand, business, or reputation, or that violates this Agreement (including the policies incorporated by reference). This is considered a "Material Breach or Violation." Additionally, you consent to us terminating this Agreement or permanently deactivating your account without notice if we determine, at our discretion, that a Material Breach or Violation has occurred.
4. Responsibilities Upon Termination: Upon termination, each party will still be responsible for any liabilities or obligations that arose before or as a result of the termination. After the Agreement is terminated, you will no longer be able to access our Platform to provide rides.
5. Acceptance of Terms: After creating an account on the Krikex.com Platform, you are hereby accepting all the terms and conditions of this agreement as mentioned.
6. Independent Business Entities: The relationship between the parties is strictly that of independent business entities, each operating as a separate and distinct enterprise that offers services outside the ordinary course of the other's business. This is not an employment contract, and you are not an employee. By accessing our Platform, you reaffirm the nature and terms of this contractual relationship. We are not employing or contracting you to provide any services; instead, you are engaging us to grant you access to our Platform.
7. No Employment Relationship: This Agreement does not establish, and is not intended to establish, any employment, partnership, joint venture, franchise, or sales representative relationship between you and us. The parties do not share any profits or losses. Furthermore, you lack the authority to make or accept offers or representations on our behalf. You are not our agent and do not have the power to act on behalf of Krikex.com.
8. Freedom to Operate: We do not, nor do we have the authority to, direct or control your actions. Subject to the availability of the Platform, you are free to decide when, where, and whether to: (a) offer P2P Services through our Platform, and (b) accept, decline, ignore, or cancel Ride requests. However, in doing so, you agree not to discriminate against any potential Rider in violation of the Requirements. As long as you comply with this Agreement, you are not obligated to accept a minimum number of Rides to access our Platform. You have complete discretion in deciding whether to provide P2P Services directly to Riders via our Platform or by using other means, including other platforms or applications, either alongside or instead of ours. That said, you acknowledge that the experience of your Riders during their Rides, as reflected in their feedback, may impact your ability to access our Platform or offer Rides in the future.
9. License to Use Platform: In accordance with the terms and conditions of this Agreement, Krikex.com grants you a limited, non-exclusive, non-transferable, non-sublicensable, and non-assignable license to use our Platform (including the Driver App) during the term of this Agreement. This license is provided solely for the purpose of facilitating Rides and accessing services related to providing Rides.
10. Account Creation and Maintenance: To provide Rides, you are required to create and register an account. All information you provide must be accurate, current, and complete, and you agree to maintain its accuracy and completeness throughout the term of this Agreement. Unless explicitly permitted by us in writing, you are limited to having one account for providing Rides. You are fully responsible for all activities associated with your account.
11. Account Security: For account security and Rider safety, you agree not to share or permit anyone else to use your login credentials or any personal information linked to your account, such as photos of yourself, to access our Platform. If you suspect that someone has improperly accessed your account, login credentials, or personal information, you must notify us immediately and change your password to secure your account. You acknowledge that Krikex.com is not liable for any losses resulting from your sharing of account credentials with third parties, including instances of phishing. 12. Authority to Accept Agreement: You represent, warrant, and agree that you possess the necessary authority to accept and be bound by this Agreement. If you are accepting this Agreement on behalf of a company, entity, or organization, you further represent and warrant that you are an authorized representative of that company, entity, or organization and have the authority to bind it to the terms of this Agreement.
13. Vehicle Requirements: You agree to ensure that your vehicle is properly registered, licensed, and suitable for providing Rides in your Region. You represent that, at all times during the provision of Rides, your vehicle will be lawfully in your possession, with valid authorization to use it for such purposes in your Region. You further agree to maintain your vehicle in a safe operating condition, meeting or exceeding safety and maintenance standards expected for vehicles of its type within the P2P Service industry. Additionally, you commit to monitoring for and promptly addressing any manufacturer recalls affecting your vehicle, as well as complying with any other applicable Requirements specific to your Region.
14. Ride Requests: Ride requests will appear in your Driver App, giving you the option to accept, decline, or ignore them. By accepting a Ride request, you enter into a direct business relationship with the Rider, based on the terms of the transportation service they’ve requested through our platform. The process for accepting or declining rides may vary depending on your location and the type of ride request. Please note that by accepting a ride, you may be subject to fees set by Krikex.com, as updated periodically.
15. Route Selection: You are responsible for selecting the safest, most efficient, and effective route to reach the destination for each ride. While the Driver App may provide navigational suggestions, these are solely for your convenience, and you are not obligated to follow them. You agree to transport Riders, or their guests, directly to the specified destination as directed, without making any unauthorized stops or interruptions along the way.
16. Rider Information: You may receive information about the Rider, including their approximate pickup location, and in turn, your Rider may be provided with details about you, such as your first name, photo, location, vehicle information, and any other information you’ve voluntarily shared through the Driver App (collectively referred to as "User Information"). You agree not to contact a Rider or use any of their User Information for any purpose other than to provide the ride, unless the Rider has given explicit consent. You also agree to treat all Rider User Information as confidential, as outlined in this agreement. Any breach of this confidentiality may violate laws, potentially resulting in civil or criminal penalties.
17. Krikex.com Branded Materials: Displaying Krikex.com Branded Materials may signal to Riders that your P2P Service is facilitated through our Platform. Krikex.com grants you a limited license to use, wear, or display Krikex.com Branded Materials provided directly to you ("Authorized Krikex.com Branded Materials") for the sole purpose of identifying yourself and your vehicle as a provider of P2P Service through our Platform. You agree not to: (i) use, wear, or display Krikex.com Branded Materials that are not authorized by Krikex.com, (ii) purchase, accept, sell, or transfer unauthorized Krikex.com Branded Materials, (iii) sell or transfer Authorized Krikex.com Branded Materials without prior written consent from Krikex.com, or (iv) display Krikex.com Branded Materials when you are not accessing the Platform.
18. No Employment Relationship with Branded Materials: Both parties explicitly agree that your access to or use of Krikex.com Branded Materials, whether authorized or not, does not create an employment or similar relationship between you and us. You further agree not to present yourself as our employee, representative, or agent for any purpose, nor misrepresent the nature of your relationship with us in any way. You agree to promptly destroy and dispose of any Krikex.com Branded Materials if your account is deactivated or if you lose access to the Platform.
19. Incident Reporting: To help us meet our compliance and insurance obligations, you agree to notify us within 24 hours of any incident (including any crash involving your vehicle) that occurs while providing a ride. You also agree to provide all relevant information and cooperate with any investigation or resolution of the incident. Additionally, you agree to notify us within 24 hours if you are arrested, charged with, or convicted of a criminal offense, as this may affect your eligibility for the Platform.
20. Geo-Location Information: Your device's geo-location information is essential for our Platform to function correctly. You agree not to manipulate or falsify this information. You give us the irrevocable right to access your geo-location data and share it with third parties, including your Riders, who will see the approximate location of your vehicle in the Rider app before and during their ride. We will not use this information to supervise, direct, or control you or your provision of rides.
21. Automobile Liability Insurance: You must have automobile liability insurance for your vehicle that covers bodily injury and property damage to third parties, meeting the minimum requirements for operating a vehicle on public roads wherever you use it. You need to be listed as an insured or a driver on your insurance policy. You will provide us with a copy of the insurance policy, policy declarations, proof of insurance identification card, and proof of premium payment, as well as copies upon renewal. If your policy is canceled, you must notify us in writing immediately.
22. Insurance Coverage Acknowledgment: You acknowledge that while providing P2P Service, your personal automobile insurance policy may not cover liability, comprehensive, collision, medical payments, personal injury protection, uninsured motorist, underinsured motorist, or other coverage for you. If you have any questions or concerns about the extent or applicability of your insurance coverage, it is your responsibility to address them with your insurer.
23. Advance Payment for Platform Fees: You can make advance payment for booking-based charges of the Krikex.com platform fee. When the amount falls below a certain limit as communicated through the mobile app, your service will be kept on hold until you clear the outstanding balance on your account. It is your responsibility to pay the required amount to the Krikex.com platform from a bank account or debit/credit card in your name only. You are fully liable and responsible for any misrepresentation.
24. Booking Acceptance: When a customer makes a booking in the area where you are located, you have the option to accept the booking within a defined timeframe. If you do not accept the booking request, any other Krikex.com partner can accept it.
25. Geo-Path Prompt: You will be prompted for the geo-path to reach the customer location or merchant location in case of food or grocery delivery. You need to follow the prompt and reach the location to start executing the booking.
26. Vehicle Maintenance: To use the Krikex.com platform, you need to maintain your vehicle in a good hygienic condition and ensure it is ready for use, including proper maintenance and sufficient fuel for the ride before being active to receive customer booking requests.
27. Active Mode for Requests: You can receive customer requests only when in active mode on the mobile app. In off mode, you cannot receive any booking requests from customers. You can set it according to your convenience.
28. Ride Fare Calculation: The ride fare will be determined based on the base fare, distance, ride time, and waiting time. These charges are reviewed according to local guidelines and mutual agreement between Krikex.com and the Krikex.com Partner. The fare will include the GST amount to be paid to the government. The entity will deposit the GST as per the rules at the time.
29. Settlement Amount: Any settlement amount will be adjusted according to the time period intimated from time to time on the mobile app. The maximum time is 7 days.
30. Customer and Partner Ratings: Customers can rate you from 1 to 5 stars based on your behavior, vehicle conditions, and ride experience. Krikex.com Partners can also rate customers from 1 to 5 stars.
31. User Rating Maintenance: You are required to maintain a good user rating above 3.5. If it falls below, platform charges will be increased compared to normal charges and will be restored upon reaching or exceeding a 3.5-star rating.
32. Low User Rating Consequences: If your user rating falls below 2.5, your account may be suspended for at least 2 months, and you cannot use the service during this time. Star ratings will be calculated based on the first average of at least 10 ratings and thereafter. You are expected to maintain a user rating above 4.5 stars to benefit from lower platform charges.
33. Earnings and Settlement Requests: You can view your daily earnings share and the Krikex.com platform's share on the mobile app. You can also request early settlement. Settlement will be done considering the ease of doing so, working days, or any other related factors.
34. Partnership Nature: Krikex.com and Krikex.com Partners work as partners based on the earning share from rides or food/grocery delivery, which does not create any additional liability on the Krikex.com Platform or its subsidiary, M/s Keshway International LLP.
35. Misbehavior and Service Quality: In case a Krikex.com Partner misbehaves or does not provide proper services, such as taxi/cab ride service, Krikex.com reserves the right to take appropriate action against the partner.
36. Dress Code and Traffic Rules: You are expected to be well-dressed and follow traffic rules, such as wearing a helmet, seat belt, and obeying traffic lights as applicable. If you do not follow traffic rules, you are responsible for any resulting situations. Krikex.com does not hold any liability in such cases.
37. Payment Methods: You will not insist that customers pay in cash only. If reported by a customer, this can lead to a penalty on your profile account. Customers can use various payment options available on the Krikex.com platform at their discretion.
38. No Extra Charges: You will not ask for any extra amount other than the ride or booking fare from the customer. Doing so may lead to a penalty on your profile account.
39. Order/Ride Cancellation: You should not cancel a customer order or ride after accepting it. The app provides pickup and drop-off details when a booking notification is received. Cancellation without sufficient reason may lead to a penalty on your profile account.
40. Platform Availability and Warranty: We provide our Platform and any additional products or services "as is" and "as available," without any guarantee or warranty. Your access to our Platform does not guarantee any ride requests. We do not warrant that our Platform will be accurate, complete, reliable, current, secure, uninterrupted, always available, or error-free, or that it will meet your requirements. We do not guarantee that any defects will be corrected or that our technology is free of viruses or other harmful components. We will not be liable for any service interruptions or losses resulting from such interruptions, including but not limited to system failures or other disruptions that may affect your access to our Platform.
41. Dispute Resolution: If a dispute arises between you and your Riders or any other third party, you release us from any losses of every kind and nature, whether known or unknown, suspected or unsuspected, disclosed or undisclosed, that arise out of or are in any way connected with such disputes.
42. Ride Request Discretion: You have the discretion to accept or decline any ride requests, especially if you have safety concerns about traveling at night or to areas known for high crime rates or desolate areas. It will be your responsibility to accept rides in these areas or times. Krikex.com will not be responsible for any loss or mishap. In such situations, you should immediately seek help from local police by dialing 100 on your phone or mobile.
43. Confidential Information: Each party acknowledges and agrees that during the performance of this Agreement, they may have access to or be exposed to confidential information of the other party or third parties ("Confidential Information"). Confidential Information includes Rider User Information, transportation volume, marketing and business plans, business, financial, technical, operational, and other non-public information of each party (whether disclosed in writing or verbally) that is designated as proprietary or confidential, or that should reasonably be known to be treated as confidential. Confidential Information does not include information that: (a) was in the receiving party's lawful possession prior to disclosure, as clearly and convincingly corroborated by written records, and was not obtained directly or indirectly from the disclosing party; (b) is lawfully disclosed to the receiving party by a third party without restriction on disclosure; or (c) is independently developed by the receiving party without using or accessing the Confidential Information, as clearly and convincingly corroborated by written records.
44. Confidentiality Obligations: Each party acknowledges and agrees that: (a) all Confidential Information remains the exclusive property of the disclosing party; (b) it will not use the Confidential Information of the other party for any purpose other than to fulfill this Agreement; (c) it will not disclose the Confidential Information of the other party to any third party, except to its employees, officers, contractors, agents, and service providers ("Permitted Persons") as necessary to carry out their obligations under this Agreement, provided these Permitted Persons are bound by written confidentiality and non-use agreements no less protective than the terms of this Agreement; and (d) it will return or destroy all Confidential Information of the disclosing party upon termination of this Agreement or at the other party's request, subject to applicable laws and our internal record-keeping requirements.
45. Modifications and Supplements: You will only be bound by modifications or supplements to this agreement upon your acceptance. However, if you do not agree to them, you may not be allowed to access our Platform. Such modifications or supplements may be provided to you electronically. From time to time, we may update information hyperlinked in this agreement (or the addresses where such information can be found), and these updates will be effective when posted.
46. Invalid Provisions: If any provision of this Agreement is found to be invalid, it does not affect the rest of the Agreement. The parties will replace the invalid or non-binding provision with one that is valid and binding, and that has, to the greatest extent possible, a similar effect as the invalid or non-binding provision, considering the contents and purpose of this Agreement.
47. Conflict with Supplemental Terms: Except for the Arbitration Provision, if there is a conflict between this agreement and any supplemental terms between you and us, the supplemental terms will prevail for the specific conflict if explicitly stated. These supplemental terms are in addition to and part of this Agreement.
48. Governing Law: Except as specifically provided in this Agreement, it is governed by the applicable law of the state where you reside (or where your entity is domiciled) when you accepted this agreement (the “Governing Law”). The Governing Law shall apply without reference to the choice-of-law principles that would result in the application of the laws of a different jurisdiction.
49. Dispute: In the event of a dispute between the Driver Partner and the Entity, we will initially attempt to resolve the matter through mutual understanding by reviewing the facts on record. If the issue cannot be resolved through mutual understanding, we will seek resolution through a mediator or arbitrator. Any associated costs will be shared equally by both parties. All disputes are subject to the jurisdiction of Jaipur, Rajasthan.
